Bluecross Laboratory got breather from court over GST summoniStockBlue Cross Laboratories had moved court with a writ petition.The Goa Bench of Mumbai High Court gave relief to Blue Cross Laboratories by asking the revenue department not to send summons for those documents which were already submitted by the company.

The company was part of many Pharma companies which received fresh summons under Goods and Services Tax in the New Year, ET had reported earlier.

Blue Cross Laboratories had moved high Court of Bombay at Goa with a writ petition.

"The petitioner is cooperating in the investigations. The petitioner has submitted all the documents required. He also fairly submits that after the filing of the Writ Petition, the respondents have issued letters instead of summons to the petitioner to comply with certain requirements for furnishing the documents which the petitioner has also complied with," the court said.

It added that no further summons are required to be issued to the petitioner for the purpose for which the earlier summons were issued," the court said.

Summons have legal binding. Any person who an officer summons is obligated to appear before such an officer. Any failure can lead to prosecution, as given in Sections 172 and 174 of the Indian Penal Code, along with a charge of a penalty of Rs 25,000 under the GST law.

In August Last year the CBIC issued an instruction to field formations saying that senior management officials of any company or a PSU should not generally be issued the summons in the first instance. They should be summoned only on clear indications in the investigation of their involvement in the decision-making process.
